Super Lawyers utilizes a complex multi-step selection process to determine its ratings. After being nominated by their peers, attorneys are subject to a rigorous independent review process, which ranks nominees based on numerous categories including their honors and awards, pro bono and community service, and verdicts and settlements. Only five percent of attorneys in the state are named as Super Lawyers, and only 2.5 percent of attorneys can be designated as Rising Stars.

Proposed Tax Changes
Congress Proposed Tax Changes
As you may be aware, Congress recently drafted proposed legislation that, if enacted, would have a significant impact on estate planning. On Monday, September 13, 2021, the House Ways & Means Committee released a proposed tax plan to fund President Biden’s “Build Back Better” social and economic spending package. It is important to note that these are only proposals and Congress is still in the early stages of the legislative process. We expect the final version of the package to include changes, possibly significant, from the current proposal.
While the full picture remains uncertain, some of these proposals would take effect on the date of enactment, others would take effect January 1, 2022 and some could be retroactive to January 1, 2021. It is also possible that a portion of the legislation would be retroactive to September 13, 2021, the date the draft legislation was introduced. Below is a summary of the proposed changes that we believe are most relevant to our estate planning clients.
Reductions of the Estate, Gift and GST Tax Exemptions
In 2017, the exemption applicable to the estate, gift and generation skipping transfer (GST) tax increased from $5 million, indexed for inflation, to $10 million, indexed for inflation ($11.7 million per person for 2021). While the increased exemption amount is slated to sunset after December 31, 2025, the current proposal would revert the lifetime exemption amount back to $5 million, indexed for inflation, beginning on January 1, 2022 (approximately $6,000,000 per person).
These proposed changes provide a limited window for individuals to make full use of their $11,700,000 exemption.

Attorney John Q. Kelly of the law firm Ivey, Barnum, & O’Mara, LLC appeared on News Nation’s “Banfield” show recently to discuss the ongoing trial of Derek Chauvin. Mr. Chauvin, a former police officer in Minneapolis, Minnesota, is charged with the murder of George Floyd. Mr. Floyd died during an arrest after Mr. Chauvin kneeled on his neck for more than eight minutes. Mr. Chauvin has been charged with second-degree unintentional murder, third-degree murder, and second-degree manslaughter.

On that day of trial, prosecutors had called several medical experts who testified as to the cause of George Floyd’s death, which they stated was due to asphyxia caused by Mr. Chauvin’s knee on his neck. Mr. Kelly noted that the defense made no objections to the experts’ testimony, and that the trial on the whole has not been adversarial. Mr. Kelly added that the trial has been all about George Floyd, and Derek Chauvin has not been humanized at all.
Mr. Kelly also discussed the potential strategies that the defense may use, including looking at Mr. Chauvin’s intent. According to Mr. Kelly, this should have been the defense’s focus from day one, and while there is no question in the jurors’ minds that Mr. Chauvin’s knee on Mr. Floyd’s neck contributed to his death, the question is whether Chauvin knew that Mr. Floyd was in distress and whether Chauvin exhibited a depraved mind or a reckless disregard for human life with his actions.

Righting the Wrong

None of the members of this close-knit community, known as the “Valley,” supposedly saw or heard anything the night of the murder. Although there were initial suspects, no arrests were ever made in connection to the killing. Delays and loose ends have caused the case to remain unsolved.

Connecticut banker Scott Hapgood is accused of manslaughter in connection with the death of hotel maintenance worker Kenny Mitchel. (Gavin Scott Hapgood v Regina in the Courts of Anguilla CLAIM No. AXAHCV 2019/0018) Hapgood has told authorities that Mitchel came to his hotel room door on April 13 at the Malliouhana An Auberge resort on the island of Anguilla, wielded a knife, tried to rob him, and threatened his daughter. Hapgood then used reasonable force to restrain him.

Attorney John Q. Kelly, who won the landmark wrongful death lawsuit against O.J. Simpson on behalf of Nicole Brown Simpson’s estate, recently appeared as a guest on Fox News’ show Shepard Smith Reporting to discuss the murder case that riveted the country 25 years ago.
The brutal murders of Nicole Brown Simpson and her friend Ron Goldman took place in 1994. Nicole’s exhusband O.J. Simpson was charged with both murders. The story captured an audience of 95 million as the criminal trial spanned 369 days. Simpson was ultimately acquitted of the double homicide in the criminal case in 1995.
Nicole Simpson’s family filed a wrongful death lawsuit against O.J. Simpson in 1997, with John Q. Kelly as lead attorney. Simpson was found liable in this civil case, which awarded $33.5 million in damages to Nicole Simpson and Ron Goldman’s families. However, to date, the families have still yet to see most of that money. When Smith asked about how much if any they have been paid, Kelly said: “Not much of anything. I auctioned off some personal property. His pensions were excluded from any collection process by law, so we couldn’t get them.”

Attorney Stephen G. Walko wins in Supreme Court case
February 2017 - Attorney Stephen G. Walko wins in Supreme Court case involving a dispute between trust beneficiaries and will beneficiaries as to the rightful owner of real property that was owned by an individual as trustee but later devised in the individual's will (CT SC 19668).
In Zara Lackman Et Al. v. Samantha Hunt McAnulty Et Al., Hugh Hunt created a trust for the benefit of his children; he served as the trustee. He conveyed certain real property to himself, as Trustee; however, the trust documents were never recorded on the land records. Subsequent to conveying the property to himself as trustee, Mr. Hunt executed a will leaving the same property to his grandchildren. Upon his death, the Executor of the Estate of Hugh Hunt omitted the real property from the probate estate under the theory that because it was owned by "Hugh Hunt as Trustee", the property passed to the beneficiaries of the trust. The beneficiaries of the will brought suit to challenge this action, claiming that the property passed to them under the will based on decedent's failure to record the trust documents on the land records.

June 2016 – In June 2013, Plaintiff Alexander Kello was working at the construction site now known as Armonk Square when he fell through an opening in the first floor measuring 6 ft. x 6 ft., landing nine (9) feet down on the basement floor, severely breaking his lower back. The opening had been cut two weeks earlier at the direction of the owner, ASQ, LLC and was covered by Dorex Corp., the general contractor.

Ivey, Barnum & O'Mara Attorneys Awarded $100,553 in Condominium Suit
April 2016 – In Rowe v. Rubin, a plaintiff who prevailed on a civil complaint was entitled to reasonable attorney fees. The trial court approved hourly rates that ranged between $224 and $400 per hour for plaintiff's lead attorneys, Edward Krumeich and Stephen Walko of IBO who were described by the court as "very experienced," "helpful" and "efficient." It was also determined that the partners made appropriate use of associate attorneys who billed lower rates.

Ivey, Barnum & O’Mara Case Among "Top Verdicts of 2014"
June 2015 - Ivey, Barnum & O'Mara's (“IBO”) representation of the Estate of Concetta Russo-Carriero in its wrongful death action against the City of White Plains was included in the New York Law Journal's "Top Verdicts of 2014". IBO attorneys presented evidence over the course of three weeks to demonstrate that the City of White Plains had failed to properly secure or protect the parking garage adjacent to the Galleria Mall, where Mrs. Russo-Carriero was assaulted and killed walking to her parked car in late June, 2005. After three days of deliberations, the jury returned a verdict in favor of Mrs. Russo-Carriero's estate in the amount of $ 1,983,000 for her conscious pain and suffering and wrongful death.
2015 High School Scholarship Program

The Ivey, Barnum & O'Mara, LLC Scholarship is awarded to a deserving Greenwich High School student who has demonstrated a commitment to their academic studies and a dedication to community service. Attorney Stephen G. Walko announced on Feb. 23, 2012 that he would seek the Republican nomination for State Representative from Connecticut's 150th District. The 150th District consists of Greenwich's shoreline from Stamford to the New York state border. The position is currently held by the Honorable Lile Gibbons who announced that she is not seeking re-election. Mr. Walko served 11 years on the Greenwich Board of Estimate and Taxation (BET), the last four as Chairman. He stepped down January 1, 2012. During his tenure on the BET he distinguished himself as a fiscal conservative. He worked diligently and successfully to manage the Town's finances which are widely recognized as being among the best managed in the country as evidenced by the Town's consistent and recently renewed Triple A credit rating.
